Officer St. Paul faces DWI charges for an off-duty building accident

The new allegations state that a St. Police officer Off-duty Paul was over the legal limit when he drove drunk into a building in August.

Bryan James McKinnon, 30, of St. Paul, is charged with two counts of third-degree DWI in connection with a crash that occurred shortly after midnight Aug. 1 at Third and Maple streets in the Dayton’s Bluff area.

McKinnon “appeared to be in shock and very distraught” at the crash site, according to the complaint.

Officers of St. Paul went to the scene called the Minnesota State Patrol to help avoid a conflict of interest.

At the scene, McKinnon refused medical attention and told investigators he was driving west on Third Street when he lost control of the vehicle.

McKinnon showed signs of impairment and admitted drinking two beers before driving, but refused to take a breathalyzer test at the scene.

He was arrested and, after obtaining a warrant, his blood was taken.

The complaint states that the samples tested positive for a blood alcohol concentration of 0.178.

The case is being prosecuted by the Minneapolis City Attorney’s Office.

Each DWI charge McKinnon faces carries a maximum penalty of 364 days in jail and a $3,000 fine.
